1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of AdvaySnapTik ("the Service"), operated by Advay ("we", "us", "Operator"). By using the Service, you represent that you are at least 13 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

AdvaySnapTik is a web-based utility that facilitates the downloading of publicly available TikTok videos, audio tracks, and photo slideshow images. The Service functions by retrieving media that is already publicly accessible on TikTok's platform and presenting it for download without the TikTok watermark overlay.

3. Permitted Use

You may use the Service only for lawful purposes. Permitted uses include:

• Downloading your own TikTok content for personal backup or repurposing
• Saving publicly available content you are licensed to use (e.g., content with Creative Commons attribution)
• Personal, non-commercial use where permitted by the content creator
• Developer and automation use via the API under the API Terms (Section 9)

4. Prohibited Use

You must not use the Service to:

• Download, reproduce, or distribute content you do not own or are not licensed to use
• Infringe the intellectual property rights, privacy rights, or other rights of any person or entity
• Scrape, crawl, or make automated requests in excess of the rate limits imposed by the Service
• Circumvent, disable, or interfere with security features, rate limiters, or access controls
• Use the Service for any commercial purpose without our express written consent
• Redistribute, resell, or sublicense access to the Service or API to third parties without authorisation
• Download content depicting minors in any inappropriate context
• Violate TikTok's Terms of Service or Community Guidelines in conjunction with use of this Service
• Engage in any activity that disrupts, degrades, or impairs the Service or its infrastructure

5. Intellectual Property & Copyright

All TikTok content downloaded via the Service remains the intellectual property of the original content creator and/or TikTok (ByteDance Ltd). AdvaySnapTik does not claim ownership of any downloaded content.

You are solely responsible for ensuring you have the right to download and use any content obtained through the Service. We strongly recommend obtaining explicit permission from content creators before downloading and using their work.

The AdvaySnapTik application, its codebase, branding, and UI are owned by Advay. Unauthorised copying, redistribution, or commercial use of the Service's source code or design is prohibited.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

We do not guarantee that:

• The Service will be available at all times or free from errors
• Any specific TikTok video will be successfully downloadable (platform changes may affect availability)
• Downloaded files will be free from defects or corruption
• The Service will remain free of charge indefinitely

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ADVAY, ITS OPERATORS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Copyright infringement claims resulting from your use of downloaded content
• Loss of data, revenue, or business opportunity
• Suspension or termination of your TikTok account resulting from use of this Service
• Any damages arising from third-party advertisements displayed on the Service

Your sole remedy for dissatisfaction with the Service is to stop using it.

8. Third-Party Links & Advertisements

The Service displays third-party advertisements and may contain links to external websites. We have no control over and accept no responsibility for the content, privacy practices, or availability of third-party sites. Interaction with advertisements is at your own risk.

9. API Terms

Access to the /api/v1/ endpoints requires a valid API key. By using the API you agree that:

• You will not share your API key publicly or sublicense API access
• You will not use the API to build competing download services without permission
• Rate limits must be respected; abuse may result in immediate key revocation without refund
• The API is provided on an as-is basis; no SLA or uptime guarantee is offered on the free tier

10. Push Notifications

If you opt in to push notifications, you may receive notifications about download status and Service updates. You can withdraw consent at any time through your browser settings. We will not send unsolicited marketing communications.

11. Termination

We reserve the right to restrict, suspend, or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Rate-limit enforcement is automatic and does not constitute individual termination.

12. Changes to These Terms

We may revise these Terms at any time by posting an updated version at this URL. Continued use of the Service after changes are published constitutes your acceptance of the revised Terms.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law in the jurisdiction in which the Operator is based. Any disputes arising under these Terms shall be resolved first through good-faith negotiation. If a dispute cannot be resolved amicably within 30 days, it may be submitted to a court of competent jurisdiction.
